Hi All,

I am having a valid multiple entry B1 visa and recently visited usa for 3 months, now my company is asking me to go again on the same visa after only 1 month of my return. i want to ask is it ok to go again so soon on the business trip ? will there be any problems at the port of entry or anywhere else? I have crosschecked with my employer they are not filing any other visa for me .. it will be the same B1. should i travel or should i decline ?

Shalu,

If your B1 visa is valid for more than 3 months then you dont need to apply for a new visa, you can go on the same visa. e.g say ur visa is valid for a period of one year with multiple entry , you can go any no of times to the US on the same visa. Every time you go to US the period of your stay is restricted by the date which is entered on your I-24 at the port of entry.

The only catch is that you are not supposed to "work" in a B-1 visa. During your immigration check, the officer might ask you about the previous trip - so be prepared to provide answers. But, multiple trips on a B-1 (each trip lasting the full 3 months) raises suspicions. I know a friend of mine who was warned that if he undertakes any future "3-month" B-1 trips, US immigration would void his visa and put him on a "watch list". So, do take care while accepting these trips - for the company it is not a big deal since they can always find a replacement but for you, since it would be in the records, any future trips to the US might be a big hassle.
