Why in case of H1-B, there is so much discrepancy.

One consultant told be that fees of processing H1B is 1500 USD and other one told 3000 USD.

One is saying it is valid for 3 years, other one is saying for 5 years.

One find me qualified for it, other one said to me that your experience is less but we can make it...

What is these all about???

I am damm confuse.



Please provide your inputs.

Well its because those "consultants" are not honest. I think (I am not a lawyer so I may not be right) for normal processing the fee is $1750 or somewhere around that. If your company opts for premium processing, where you get the result on your case in 15 days, INS or UCSCS charges your comapny $1000 extra.
H1 is valid for 6 years unless you have filed for GC and the filing has passed certain stage before the end of your 6 years on H1. The consulate may stamp your fresh H1 validity for 1 year/ 1.5 years, 3 years etc. but then if its a fresh H1 after a gap of a year outside US, you can get it extended for 6 years.

Your consultant may give you some twisted information to confuse you and make you feel that you have no choice but to aggree to his demands (such as security deposit, passport submission). You can always get official information from INS sites or www.murthy.com

Here are my quaries

1. How many years of experience one should have as a minimum requirement for applying H1B.

2. Does any certifications like(Sun (or) Microsoft) mandatory (or) will it improve the chances of getting H1B.

3. How long does it usual take to process a H1B visa.

4. Can a candidate apply directly (or) it has to be done through a consultant (or) company from US.

I know these two:

A 4. H1-B require petition (written document from client). Individual can't apply for H1-B.

A 3. It takes 3 to 6 months to process H1-B.

Yes you apply directly but do you know any company which does so?

Important thing of all is you need to have an offer (Job) to work in USA. Which should be presented at the consulate when your appearing for your VISA Interview. I think people at the consulate do not care about the certifications except job offer.

When your employer apply for your H1B petition they have to prove that they don't find anyone here in USA with the skillset they require and you have it. In which case, more experiance and certifications will definetly help.

They should have to prove that they cannot find cheap candidates who will accept sub-standard pay. Skills has nothing to do with it. What skills do Indians have which Americans - the richest country in the world which probably invented the "skill" in the first place, do not? It's fraud.

I still does not see any reason why term CHEAP comming into picture.
If anyone has talent and they really expose it very well then they definelty get paid very good.

And salary they offer is as per the standards and market rate. And most of the times it depends on budget allocated. If they have less budget then irrespective of race you will get paid less.

And it is upto the candidate to accept the offer.

H1B pay is lower than what a native with the same experience and education would get. Why? The pay is good if you're from a non-industrialized country which pays lower wages. I'm talking about Dollars and Euros, not Rupees.

When you are on H1B you have to work on salary basis not hourly basis. Most of the times we compare ourslef with people salary who work hourly and most of them will be citizens or greencard holders and who are in consulting.

If you compare H1B Sal with full time (salaried) employee then you will not find much difference.

Also I am not saying that you are wrong and I am right.
It is just what I have seen.
