Processing H1-B through two companies??

Hello,

I would like to know if two H1 visas can be approved for a same person and me stamping only one.

I have offer from two companies for my H1-B, but I�m afraid if I choose one and unfortunately at the time of issuance (starting 1st Oct 2006), suppose it gets rejected or something... ..I�ll be denied the opportunity.

So I�m thinking of processing my application through both the employers and on approval, can select the better offer (the reputed company) and stamp that visa.

Now my question is:
Is this possible?? Is there any problem if two employers file for my H1-B processing?
Since my application is going by two employers, is there a possibility that both get rejected?

I�m in dilemma and unable to decide. Feedback and suggestions are highly appreciated.

No Problems with having multiple H1B petitions filed on your behalf. Its perfectly legal and you can get all the petitions (I 797) approved also. Only thing is you can have only one valid H1B visa stamped on your passport. So if you get both the applications approved, you can decide which one do you want to stamp on your passport. Get it stamped and then come to USA.

I appreciate your timely response. There was a speculation in air about INS getting strict on this matter and multiple candidates applications getting submitted by various employers.

If one person sees them both and remembers it they may turn down the second one (or maybe both), but what are the chances of that?
With tens of thousands of applications coming in all the time, it's unlikely to happen.

It would however be unethical, as you'd be having 2 visas out of a quite small and fixed total number while you need only one. You'd be denying someone else the same opportunity you seek.

Well even if the same visa officer sees your application and remembers it the second time, on what grounds he can reject the visa ? Surely having applied for and received H1B visa earlier can not be the reason for rejection. Its like saying no you already have a job and you can not try for a better job as there are others who want that job. Isn't it ?
About being ethical, well its a very subjective argument. IMHO if you are not doing anything illegal, and trying to take good care of yourself (by having multiple job offers in hand.. multiple job offers = multiple H1B visa for non-immigrants) then there is nothing un-ethical in that. But then again its my opinion.

Someone hinted the INS is getting tough on it, and they should IMO.

H1 isn't meant to get people a job elsewhere and then come to the US. It's about a US company looking outside the US to fill positions they can't fill at home.
If the system is abused on a massive scale as a means to get inexperienced low-pay labour into the country that's doesn't make it right.
Under the spirit of the system you'd get a job in the US under the condition that your H1 application is approved, then start the paperwork.
You're not supposed to just apply for a handfull of H1 visa supplied by some front companies and then go jobhunting once you have those in your pocket.

I beg to differ on this. It is perfectly legal to work for "front companies" (consulting companies) on H1B. All you need is proper documentation. And salary from the day one. So when you come here on H1 you have a job with your consulting companies. It not that you are coming on work visa (e.g. HSMP in UK ) and then looking for a job. You already have a job and then you are looking for contract.
And H1B applicant has a choice to decide which company he wants to work for if multiple companies are ready to offer him a job and file for his visa. INS doesn't say that you can not apply for multiple job or you can not get offers from multiple companies.
INS is getting strict on fake resumes / bogus consulting companies but not on having multiple H1B petitions.

That's the typical front company I'm talking about.

Jeroen, to clarify you when I mentioned here multiple employers they are the front runners and not those so-called body shoppers.

And I�m not here to snatch some other potential candidates� opportunity. Also, I�ll b stamping only one visa so I�m not traveling on two employers boat. It�s a free, professional and competitive world and one has the right to choose the opportunity that comes by if he has the right caliber and potential. So lets not stray away on ethical and principles lines here Jeroen.

As Rohan rightly pointed out, if two companies have found you potential, there isn�t any harm in trying both of them.

Hi,
It's fine to have 2 offers. But anyways you told yo will decide one company to join or get stamped. So it would be great for someone if you can do it now, so the extra one can go to another person or another company.
Just my opinion though.

Is there any change in the rule for 2008? Can a single candidate have multiple applications for H1B and later go in for stamping of visa against any 1 of them?
