I am working on Java/J2EE tech. for the last 3 year, in financial domain.
I started my career with a company K* and worked for a banking client H* for about 2 years and gained substantial knowledge on their app. framework. 4 months ago I resigned there and moved to a small firm in Chennai that sent me to onsite to HongKong, as a cordinator and portal developer for H*.
Hardly within 15 days of my stay there,I had to come back to India on personal reasons in an emergency(a death in family in october). The project there at HK was at a critical juncture, and I told my bosses back in Chennai that I need to take a long leave.
You wouldnt beleive it, but these guys wanted me to show proof of the emeergency situation(hospital bills,certifgicate etc)...Can you imagine any company asking for those?I really got pissed off and told them that I will not provide them anything like that...
The next day my webmail access was halted, and I was ready for the worst... I understood(at a very late point) that these guys are not at all professioanl and am now applying for firms with 3 yrs experience...
Understandly, there was no communication between us now and I do not have an experience /relieving lettter as of now. I do possess the appointment letter/company id card and the pay slip for august.
Ideally Im looking for an onsite jave developer/cordinator opportunity. Will my situation be a problem for H1B filing for next year?
I would like you guys to advice me on how should I approach the interiew/HR ppl on how to explain this situation to them. ie; not having expeiemc/releiving letter etc..I have experience lettter upto June 2006 from my previous emplyer(K*).
I am pretty confident of my tech. skills and am getting calls from bigggies like SAP,Satyam,IBM etc..
Please advice me on what would be best for me to do...

Hi, To be honest any company would be a bit suspicious if one would ask for a long leave immediately after joining, not to mention a small company, since the pressure is too much already on them.
Leaving that alone, though I am not an expert in h1-b related matters I don't think it should be a problem, if you can find yourself a job in a reasonably reputed firm. However it's better if you take some expert advice.
See if its possible to convince your ex employer for an amicable solution. I am not sure if you have resigned from that company yet. Start a converstaion. It would not be easy but something that you may need to do.
As far as the bigges you have named, there will be a strict background check done. Also, if your ex employer comes to know about next comapny(whereever you join) they could create trouble.

First, many thanks Badari and Vibhav for your replies and advice.
I understand that this is a situation which is unwanted in one's career, but even if I ask the company where I moved out from, I'm sure they will not give me a letter, and even if so, will include that I am terminated kind of remarks.
I have asked some job consultants on this whether I need to skip my entire 4 months of experience in the last firm while putting in my applications,but they advised me to include this experience but to explain in the HR rounds of the situation where I had to leave. I am now ready to even take up a contract position(Ultimatley,I beleive its the tech. skills that matters..)
As far as background check is concerned, I know that big companies like IBM do it strictly, thats where I badly need you guys' advice. Please tell me how I can convince diplomatically in the HR round that I had to leave(i mentioned the reason in my first post), without looking as if I am blaming the prev. manager etc...
Just hoping that everything is happening for the good for me...(now thats philosphy/sentiment )...
1. No problem for H1 visa because you REALLY worked for them, you have the OFFER LETTER from them. If they say you never worked for them in any background check, you can proceed legally with your documentation you got from them.
2. Just be honest in interviews about the situation you faced. You tell them that you didn't liked their approach of asking for proof in familiy situation.
3. Be confident, you will get a nice job easily.

Do not exclude your 4 months experience. 4 months gap in your career becomes negative point in your resume and what ever personal reasons you show may not convince your employer. You keep your experience and explain the HR people in what circumstances you left your previous job. Few companies may ask you the proof that you legally attached to your previous company, for that if you can submit copy of resignation mail or letter that will be good help. As part of background check you can submit your offer letter, last pay slip to proof of your previous employment.
