<jsp:param name="colspan" value="8"/>
</jsp:include>

<jsp:include page="a.jsp" flush="true">
</jsp:include>

will fail because there is no parameter. This format can only be used with a parameter.

<jsp:include page="a.jsp" flush="true">
<jsp:param name="colspan" value="8"/>
</jsp:include>

should work. I tested it out on my computer and it works.
