what i think of that it should be part of the solution, as an architecture of the system should address major technical risks..also how far we need to dig for risk or just need to focus on most obvious ones.
A risk resolved in your propose architecture is no longer considered a risk.
I believe that the list of risks refers to something that you did not address in your proposed architecture but being something that you're aware of that can happen as architect.

Yes,That is the solutuion/Mitigation when it get addressed in the proposed architecture.As an architect one has to envision the technical risk and provide the solution as the final out come.I think the risk you are talking about falls under the category of non technical risk like development/management and others.
Architectual developement is a continuous process,the final architectural views must address major technical challenges/risk,it should not be in just "i'm aware of .." state.

You are perfect correct about "Architectual developement"...but OCMJEA is not a "continuous architectural development"... is just another certification.
As I already said, you're free to make your decision.
It is worth mentioning that you need to follow your assignment and justify their assumptions.
