HI all
I have a query regarding Back ground verification. I had worked in Uk company. It is very small company after my studies which even don't have any domain name. After coming back to India. I got placed in One MNC company. They have asked me FOR 16, Pay slips and offer letter and exit letter.

As said it is very small company. they have paid by cash in hand. And for that Uk company there is no form 16 and of course my is not taxable. The company wont have any formal procedure for hiring employees. So I don't have ANY offer letter but company provided the experience letter. So I dont have any Offer letter , FORM 16, PAY SLIPS

I have informed every thing to my present company all things, But they are telling that I am not providing all the documents hence they will terminate me. I have explained clearly and mailed as well/. But they considering that I am not PROVIDING but not considering that not applicable for me.

Finally But my Present company is asking for offer letter, Pay slips and UK BANK STATEMENT. Unfortunately I can not get either of this because its been already 4 years I came out from Uk. All my accounts are closed.

IF I didnt submitted bank statements they will surely terminates me. My queries are

1. How BGV will be dont by using bank statements.
2. What kind of information they can get by using Bank statements.
3. How they will verify about my past job verification by using Bank statement as there will be no details in the statement.
4. How they will verify that document which I have provided is original / Fake

Don't know about the UK, but here in the US, getting paid in cash, is mainly done when you are working "off the books" -- and unless you are a 15 year old working on a newspaper route, the practice is very likely illegal. Kinda pointing out the obvious, but you probably should not have mentioned the illegal work experience.

If you are from outwith the UK whoever paid you is probably committing a crime too: it would be regarded as employing somebody not entitled to work in UK.

I agree with Henry that it sounds very dodgy. With particular note on this statement:

You say "not taxable", but I suspect you have not paid tax because you have not declared your income. An illegal practice, colloquially termed "tax dodging". Unfortunately this raises a number of other questions: Why were you paid cash? Was it because you were employed illegally? Was the company evading tax? Were you (knowingly) evading tax? Did you have the right to work in the UK?

It sounds like you're going to have a hard time explaining this one.

In India I think one is allowed a cash transaction, but there is an upper limit to it. I think it is around 20,000/00
In such a case, you can always obtain the signature of your employer on a debit/credit voucher and can present it as proof of employment.
Needless to say I am not a lawyer and you should obtain proper legal advise before taking any informed decision.

It is quite legal to pay wages in cash in UK, too. But it would have to be accompanied by a tax code and tax would have to be calculated, and on leaving the ex‑employee must be given a P45. I suspect that is the British equivalent of the form 16.
