I cann't kill apache process even with kill -9

I am using RedHat Linux3.0 and apache 2.054.
I could not stop apache by using apachectl -k stop
I still see process listening/binded to port 8080 as
netstat -lnp|grep 8080
(Not all processes could be identified, non-owned process info
will not be shown, you would have to be root to see it all.)
tcp 0 0 0.0.0.0:8080 0.0.0.0:* LISTEN 15812/httpd
even doing kill -9 15812 would not wipe off this process
with ps the process is shown as :
1 T apache1 15812 1 0 75 0 - 59221 finish Jun30 ? 00:00:00 /opt/app/apache/apache1/test-apache/apache/bin/httpd -k start
T means stopped or traced state but I am not doing any tracing
I want trebooting the box as my last resort and I am looking for a way to avoid this problem which is happening frequently.
I tried killall also but it is not working.
