IBM sample test questions ...is it legal to post here?

Hello,
Everyone knows that IBM prime tests/ sample tests are paid test ($10 per attempt).
Also the test questions are the same, it repeats for every attempt.
Now the question is...
* Is it legal to post a paid test question in a public forum like this..?
* Aren't they considered as real question?.
* Isn't it wrong to cut and paste real question (since it is paid) here?
(for example we have long post for 484, 483, 287, etc)
* For example, you are not legally allowed to post all Whizlab questions on a public forum and discuss, eventhough they are sample test but they are paid.
The site owner, Moderators and the members...
* What do you think about this?.
* Could we ask IBM to answer this question?.

I don't see any reason we couldn't ask IBM about the matter if it's not covered in their Terms of Service. I haven't looked myself to see if they cover that point.
I think that would be the major issue to address as to 'should we' - if they don't have a problem with it, I see no reason that we can't discuss the matter in these fora.

In most cases the sample questions are exactly the same they were when they used to be free. So if we could post those set of questions earlier, what makes the posting of the same questions inappropriate now.....
I took the sample test before december when it was free. When a month later I took the same test after paying 10 dollars - the questions were exactly the same (I did get a free voucher though).

I've actually addressed this issue a couple of times. Basically, we don't know. Howard Kushner was checking with IBM since he's got a direct line to over there, but haven't heard back.
Since I don't have their agreement in front of me, and have no idea who at IBM would be the best to talk to (I've never taken these tests, and no next to nothing about them, let alone the ICE stuff), I would hesitate to make a definitive answer.
Personally, if you pay for something, I don't see why you would want to post the questions for everyone else to grab for free. But that's me.
Also, many of the posts that have the sample questions were made before you had to pay for them. If they are the same tests, the people who didn't have to pay for them probably didn't have to click on an agreement and therefore in my opinion it's ok for them to post it.
As soon I know more, we'll have a post stating Javaranch's official policy. In the mean time, I'll ask the boss man what his take on it is and how to proceed.
Sorry it took me so long to reply, I've been out sick with the cold and trying to get final revs done at work at the same time, so haven't had time to bounce in here.
