Suing for potholes

I hit a pot hole in the shitty roads of New Jersey. I got a flat and will have to replace the tire...

Can I sue the department of transportation or Jersey City? I know that you can take a picture of the pot hole, and a picture of the car tire damage and get a refund for the repair..

But I want to actually find out if I can sue them legally.

No idea about US law.

If this is legal in India, Indian Government would be bankrupt within a day.

Day befoer yesterday I was thinking to sue Govt for potholes, because I just happend to escape an accident... but not in NJ but in Bangalore

And frankly if I would have any pillion rider then it would have surely fallen down

This kind of suing has become very popular in the UK. I remember reading about one local authority who were spending more of their budget on paying compensation then on mending the roads. This meant that less roads got fixed, and they had to pay out more compensation! The cycle continues, and legal processes aimed at increasing road quality have lead to it decreasing.

Another big problem with potholes is for the emergency services. An ambulance cannot go as quickly on a bad quality road as on a good quality road.

Update: I found out that I can claim for the damages with the department of transportation. Dropped the idea of suing(can't bear the headache).
